I hereby grant to Kenney Ortho Group, Inc., its licensees, successors and assigns, and each of their respective parents, subsidiaries and affiliates, and each of their respective officers, directors, shareholders, employees, agents and representatives (collectively, “KO”), the right to record and photograph me and to use my name, image, likeness, voice, appearance, information and comments about me as such may be embodied in any pictures, photos, videos, recordings, audiotapes, digital images and the like (collectively, the “Materials”), in connection with any advertising, merchandising, promotions, education and publications for KO including, but not limited to, news releases, e-mails, magazines, bulletins, exhibitions and other communications in any medium now known or later developed. I hereby waive any and all rights to inspect or approve the finished Materials prior to their use whether that use is now known or unknown to me. I will not be paid for any of the rights listed in this Release and hereby waive any and all rights to royalties or other compensation arising from or related to the use of the Materials. I agree that KO shall own all of the rights to the Materials, and I assign and transfer any and all rights, including copyright, I may have in the Materials to KO. I, on behalf of myself and my heirs, executors, agents, successors and assigns, agree to release from liability, never sue, and bring no proceedings of any kind against KO for any claims, actions, damages, losses, costs, expenses or causes of action whatsoever that in any way relate to this Release or the creation, use or exhibition of the Materials. This Release supersedes all prior oral or written communications and I am not relying on any promise or statement not contained herein. I represent that I am at least eighteen (18) years of age and am fully competent to sign this Release. I HAVE HAD AMPLE OPPORTUNITY TO READ THIS RELEASE AND HAVE IN FACT READ AND UNDERSTOOD THIS RELEASE.
